1. Introduction
Welcome to Apeiro, a service provided by Arachnida ("we," "our," or "us"). By accessing our website, creating an account, or using our services, you agree to be bound by these Terms and Conditions. Use of our service is also governed by our Privacy Policy.
2. Virtual Currency (Sparks)
Apeiro uses a virtual currency mechanism called "Sparks" to limit and meter access to AI-powered features.
- No Monetary Value: Sparks have no real-world monetary value, are not transferable, and cannot be redeemed for cash or other currency.
- Refills: Sparks are refilled daily based on your subscription tier. Unused Sparks do not rollover to the next day.
- Modification: We reserve the right to modify the cost of features (e.g., trivia generation cost) or the daily allocation of Sparks at any time without prior notice.
3. Subscriptions and Payments
We offer paid subscriptions (Premium and Elite) to increase your daily Spark limit and remove advertisements.
- Merchant of Record: Our order process is conducted by our online reseller, Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. By subscribing, you agree to Lemon Squeezy's Terms of Service.
- Billing: Subscriptions are billed in advance on a recurring basis (monthly).
- Cancellation: You may cancel your subscription at any time via the Lemon Squeezy customer portal. Your benefits will continue until the end of the current billing period.
- Refunds: We generally do not offer refunds for partial subscription periods. Exceptions may be made at our sole discretion or as required by applicable law.
4. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
- Termination: We reserve the right to suspend or terminate your account at our sole discretion if you violate these terms, attempt to manipulate the Spark system, or engage in abusive behavior.
- Account Deletion: You may delete your account at any time through the Arachnida Auth Portal. It is your responsibility to cancel any active subscriptions before deleting your account. While we make reasonable efforts to automatically cancel subscriptions associated with deleted accounts as a courtesy, we cannot guarantee this process and are not liable for any charges incurred after account deletion due to active subscriptions that were not cancelled.
5. AI Features and Output
Apeiro utilizes third-party Artificial Intelligence (AI) models to generate content (trivia, puzzles, etc.).
- Disclaimer: AI generation can be unpredictable. We do not guarantee the accuracy, quality, or suitability of AI-generated content.
- Ownership: You retain ownership of inputs you provide. Output ownership is subject to the terms of the underlying AI providers.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARACHNIDA AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
7. Governing Law
These terms shall be governed by the laws of the United States, without regard to its conflict of law provisions.
8. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
9. Entire Agreement
These Terms regarding the Service supersede and replace any prior agreements between you and Arachnida regarding the Service.
10. Changes to Terms
We may modify these terms at any time. If we make material changes, we will provide notice through our services or by other means. Your continued use of the service constitutes acceptance of the new terms.
